This week, the Senate Finance committee passed  S. 1347, the Electronic Health Fairness Act, which would exempt all patient encounters in an ASC from Meaningful Use reporting. Currently, no EHRs are certified for use in ASCs, and Meaningful Use requires eligible professionals to report on at least 50% of patient encounters—making achievement difficult for physicians who practice in ASCs. The bill would maintain the exemption for three years following any eventual certification of an EHR system for use in ASCs. As we reported last week, the House version of this bill was incorporated in other legislation that passed the House. We will keep you updated.
